On September 9, 2022, Wild Fish Conservancy submitted a motion for final order in a case against NOAA Fisheries (Case No. 20-cv-417-RAJ) that included a temporary restraining order and/ or preliminary injunction. The relief was filed in response to summary judgement issued on August 8, 2019 by U.S. Judge Richard A. Jones that approved and adopted Magistrate Judge Michelle L. Peterson’s Report and Recommendation, which overwhelmingly agreed NOAA Fisheries violated the Endangered Species Act and the National Environmental Policy Act by relying on unproven future mitigation measures the agency claimed would offset ongoing harm to ESA-listed species when authorizing the Southeast Alaska Chinook troll fishery. |
